Mudzuru & Anor v Minister of Justice, Legal & Parliamentary Affairs & Ors CCZ 12/15

The landmark Constitutional Court ruling that declared child marriage unconstitutional in Zimbabwe. The Court set 18 as the minimum age for any form of marriage, civil, customary or religious, regardless of parental consent.

Outcome / SignificanceSection 22(1) of the Marriage Act and Section 78 of the Customary Marriages Act were struck down. The minimum marriage age was set at 18.

Mhondiwa v Mhondiwa SC 32/20

A significant matrimonial property case clarifying how the indirect contributions of a non-earning spouse, including homemaking and child-rearing, are valued in the division of matrimonial assets on divorce.

Outcome / SignificanceThe Court affirmed that indirect contributions are valued equally to financial contributions in equitable distribution under the Matrimonial Causes Act.

A widow inheritance dispute that reinforced the protections offered to surviving spouses under the Deceased Estates Succession Act, particularly where customary norms and statutory law come into tension.

Outcome / SignificanceThe surviving spouse's rights under the Act were upheld over competing customary claims by extended family.
